Woman burned alive in Quebec: the ex-spouse will remain detained
The taxi driver Frej Haj Messaoud, accused of having attempted to immolate himself by fire his ex-spouse in the middle of the street in Quebec city, will remain detained for the duration of the procedures.
Judge Alain Morand of the Court of Québec has made the decision Wednesday at the end of the day, after a full day of investigation release.
The tragedy happened at about 21 o’clock on the 9th of August last, on the rue Arago Ouest on the Saint-Sauveur district. The young woman of 27 years would have been splashed with petrol by the accused. The latter would then put the fire on her before fleeing. The young children of the couple and the victim’s mother were witnesses to the event. A neighbor rescued the young woman, badly burned on a large portion of his body.
Frej Haj Messaoud, 39 years old, of tunisian origin, was arrested on August 10, in Drummondville. He has been accused of attempted murder and aggravated assault.
The Crown prosecutor Me Sabrina Lambert-Michel objected to the release during the proceedings. It was she who had the burden to convince the judge that the detention of Messaoud was necessary to ensure the safety of the public, and in particular that of the complainant, and to avoid undermining public confidence in the administration of justice.
Remember that in canadian criminal law, the rule is the release during the proceedings.
The evidence of the police against Frej Haj Messaoud, told the judge during more than an hour, under an order of non-publication. The same order, pronounced at the request of the defence counsel, Alex Savoie of the office of the legal aid covers also the arguments of the parties and the reasons given by the judge to support his decision.
The inquiry under release took place in front of the parents of the complainant as well as in front of a few friends of the accused.
It will be forbidden to Frej Haj Messaoud to communicate with the complainant and members of his immediate family during all court proceedings.
